Here’s the rub; current law allows these agencies and employees to accept private grants and donations like a they’re a charity. Anyone with half a brain can see the conflict of interest here. I only listened to a small clip. The part when Bernie Sanders went off on his ridiculous rant and Kennedy said I don’t even know what you’re talking about. I’ve been a strong supporter of Kennedy for a long time, and what amazes me is how he can hold his temper and not lose control. He can do this because he has the FACTS and the data to show for all to see. He reminds me of his amazing father and uncle who stood up to the liars and called out the corruption and unfortunately died for doing that. I know this is showing my age, which is fine. I pray for Kennedy and all the voices out there for defending our democracy. I fear for my grandchildren growing up in this environment. Sorry for going on but these hearings upset me. I’ll stop now. Last night, Newsmax slanted its hearing coverage to let us know that Bobby was most likely to be quickly fired by Trump for alienating Democrat senators and causing chaos in the CDC, you know, by forcing out docs who practice satanic rituals? Bret Baer did the same, as did Laura Ingraham. But Jesse Watters gave us a different take on the hearing i.e. that Kennedy knows what he’s doing and the senators are on the take with Big Pharma, just like Baer and Ingraham and Newsmax depend on Pharma commercials. Pharma must be banned from advertising.

As far as pharma advertising - I've been saying for years that it needs to stop. If cigarettes can't be advertised on tv, why should drugs? They're just as addicting and bad for you.
In the case of Laura Ingraham last night, it wasn’t so much as what she said, but it was the video clips she showed: the story those clips told contained the narrative that Kennedy was in real trouble. It wasn’t until I watched Watters that I understood that Kennedy had done a masterful job in the hearing. I should have been clearer.
Sadly, Pharma will not be able to be banned from advertising because in the 80's the
Supreme Court ruled that direct-to-consumer advertising is a protected form of free speech under the First Amendment. However, there are other things Bobby can do that are within his purview to change the content of ads (that would have a chilling effect on pharma then making them at all), and I believe he is going to do them.
You're right that pharma wasn’t always able to advertise directly to consumers, but it's important to clarify that it wasn’t because it was outright illegal. Instead, the FDA's rules before 1997 required full prescribing information, which made drug ads practically impossible on TV or radio. The industry mostly avoided DTC advertising because the legal landscape was uncertain and risky. FDA rules made it unclear how to comply, and companies feared enforcement or liability if they got it wrong.
That changed in 1997 when the FDA loosened the rules. Drug companies were then allowed to include just a summary of risks along with directions for how to get full information. That opened the door to the ads we see today.

After reading the SCOTUS opinion regarding tv ads I'm not positive that the Central Hudson case can be used to keep pharma ads on tv. My uncertainty is based first in the fact that a public utility company is different in character and purpose from a drug company. Second, if Bobby Kennedy thought the ads could be banned, he must have seen a legal loophole that he could advance. Third, the Court might see fit to reverse its own previous position, something they have done in the past. Fourth, I think the government could show "substantial interest" in banning ads. In the end, I'd love to see this played out somehow. One other thing: while drugs are lawful, so is tobacco (although not physician-mediated), but drugs have huge built-in side effects (including death). That could be the basis of banning ads. Another idea: ads are for commercial purposes so that a company can sell them, but since drugs are physician-mediated, the primary audience should be to selling doctors on them instead of the public who largely is ignorant of how these molecules work. Again, I'm not sure here, just spit balling. 🥴

I don't think Congress can pass a bill about this. The Supreme Court would equally knock it down (just like they would with something coming out of the Executive Branch) as unconstitutional legislation, if they felt it violated 1A.
Oh, there are ways for Congress to get around any Court ruling. It's all in the language. And it's happened before. I keep thinking that Bobby wouldn't have called for an end to those ads if he had not already given it lots of thought and had a plan for doing it. Maybe it could happen through regulatory action. I'm not clear on all the historical details, but at some point in the past, corporations were granted the status of "personhood", and that changed everything.
They were granted rights and privileges that were never theirs in the first place.
Granting personhood to corporations began in 1886 with SCOTUS holding that the 14th Amendment applied to corporations. Over time, that idea evolved (all of it through SCOTUS rulings) until we are where we are today. There was one ruling in the Progressive Era that pushed the idea forward, and there have been others at various times too. The last big one was the 2010 Citizens United opinion. So there's a lot of precedent. The best way we could end this insanity is through a constitutional amendment. It's hard work but not impossible and that would settle the issue once and for all. One last detail about corporate personhood: it's pretty much a patchwork quilt of rights inasmuch as corporations can't marry or vote and or invoke the 5th Amendment against self-incrimination. But they have 4th Amendment rights. They do not have blanket personhood.
America has a long history of failing to act on fundamental issues (like slavery) until it's impossible to ignore the problem anymore and then we get busy and address it. I have hope that will happen with this problem. And I think we are entering a phase in our history where the matter of corporate personhood becomes more likely to become wiped off the books, either through a SCOTUS ruling or constitutional amendment.

Unfortunately often people are not allowed viable alternatives. Even the red states are controlled by the Party. They funnel Party donations to their preferred pick in the primaries. I ended up with a Democrat identifying as a Republican for my congressman, thanks to huge funding from the GOP. There were 3-4 far more Republican candidates in the race, yet the GOP chose to support the candidate farthest to the left. It's despicable.
There’s always the option of a write-in. It’s not a wasted vote. It’s a statement that the available candidates are not acceptable and we’re not going to vote for them any more. Until we insist on that, we’ll get more of the same. The voters need to stop caving to the Big Money. Until we stop caving we can’t complain about the politicians who cave.

Here’s the rub; current law allows these agencies and employees to accept private grants and donations like a they’re a charity. Anyone with half a brain can see the conflict of interest here. In order to truly change the ecosystem of the CDC and FDA, they need to change the law to prevent this.

Particularly appalling was the Senator who said RFKJr will have the deaths of children on his hands for not pushing vaccines. Good morning. Excellent as always. I’m so very tired and disgusted on how these so called Senators continue to try and crucify Kennedy, and in so doing making fools of themselves. I only listened to a small clip. The part when Bernie Sanders went off on his ridiculous rant and Kennedy said I don’t even know what you’re talking about. I’ve been a strong supporter of Kennedy for a long time, and what amazes me is how he can hold his temper and not lose control. He can do this because he has the FACTS and the data to show for all to see. He reminds me of his amazing father and uncle who stood up to the liars and called out the corruption and unfortunately died for doing that. I know this is showing my age, which is fine. I pray for Kennedy and all the voices out there for defending our democracy. I fear for my grandchildren growing up in this environment. Sorry for going on but these hearings upset me. I’ll stop now. Last night, Newsmax slanted its hearing coverage to let us know that Bobby was most likely to be quickly fired by Trump for alienating Democrat senators and causing chaos in the CDC, you know, by forcing out docs who practice satanic rituals? Bret Baer did the same, as did Laura Ingraham. But Jesse Watters gave us a different take on the hearing i.e. that Kennedy knows what he’s doing and the senators are on the take with Big Pharma, just like Baer and Ingraham and Newsmax depend on Pharma commercials. Pharma must be banned from advertising.

As far as pharma advertising - I've been saying for years that it needs to stop. If cigarettes can't be advertised on tv, why should drugs? They're just as addicting and bad for you.
In the case of Laura Ingraham last night, it wasn’t so much as what she said, but it was the video clips she showed: the story those clips told contained the narrative that Kennedy was in real trouble. It wasn’t until I watched Watters that I understood that Kennedy had done a masterful job in the hearing. I should have been clearer.
Sadly, Pharma will not be able to be banned from advertising because in the 80's the
Supreme Court ruled that direct-to-consumer advertising is a protected form of free speech under the First Amendment. However, there are other things Bobby can do that are within his purview to change the content of ads (that would have a chilling effect on pharma then making them at all), and I believe he is going to do them.
I thought drugs were in a different category than “Captain Crunch.” It wasn’t always legal for pharma to advertise and they need to go back to that.
You're right that pharma wasn’t always able to advertise directly to consumers, but it's important to clarify that it wasn’t because it was outright illegal. Instead, the FDA's rules before 1997 required full prescribing information, which made drug ads practically impossible on TV or radio. The industry mostly avoided DTC advertising because the legal landscape was uncertain and risky. FDA rules made it unclear how to comply, and companies feared enforcement or liability if they got it wrong.
That changed in 1997 when the FDA loosened the rules. Drug companies were then allowed to include just a summary of risks along with directions for how to get full information. That opened the door to the ads we see today.
The challenge now is that courts have strengthened First Amendment protections for commercial speech since the 1980s. As a result, any new attempt to ban drug ads entirely would likely be struck down as unconstitutional, even though most countries still prohibit them.
Corporations are not people. They should never have been given the "rights" of free people. The corruption here is very old and very deep.

An outright ban on all DTC ads for approved drugs likely fails prongs 3 and 4; it’s overly broad when less‑restrictive options (like disclosures or limited bans) exist. Courts also view medicine differently from tobacco: drugs are lawful, socially valuable, and physician‑mediated. That makes a sweeping prohibition unlikely to survive constitutional review.
After reading the SCOTUS opinion regarding tv ads I'm not positive that the Central Hudson case can be used to keep pharma ads on tv. My uncertainty is based first in the fact that a public utility company is different in character and purpose from a drug company. Second, if Bobby Kennedy thought the ads could be banned, he must have seen a legal loophole that he could advance. Third, the Court might see fit to reverse its own previous position, something they have done in the past. Fourth, I think the government could show "substantial interest" in banning ads. In the end, I'd love to see this played out somehow. One other thing: while drugs are lawful, so is tobacco (although not physician-mediated), but drugs have huge built-in side effects (including death). That could be the basis of banning ads. Another idea: ads are for commercial purposes so that a company can sell them, but since drugs are physician-mediated, the primary audience should be to selling doctors on them instead of the public who largely is ignorant of how these molecules work. Again, I'm not sure here, just spit balling. 🥴

I don't think Congress can pass a bill about this. The Supreme Court would equally knock it down (just like they would with something coming out of the Executive Branch) as unconstitutional legislation, if they felt it violated 1A.
Oh, there are ways for Congress to get around any Court ruling. It's all in the language. And it's happened before. I keep thinking that Bobby wouldn't have called for an end to those ads if he had not already given it lots of thought and had a plan for doing it. Maybe it could happen through regulatory action. But at some point, Bobby will take it on, and then we'll know.

I agree with you that pharmaceuticals should not be allowed to advertise directly to patients. Your argument about corporations not having the same rights as citizens is sensible, logical, and should be the standard, especially when it comes to free speech. I had always thought that commercial speech had some restrictions on it. But that may have changed.
I'm not clear on all the historical details, but at some point in the past, corporations were granted the status of "personhood", and that changed everything.
They were granted rights and privileges that were never theirs in the first place.
Granting personhood to corporations began in 1886 with SCOTUS holding that the 14th Amendment applied to corporations. Over time, that idea evolved (all of it through SCOTUS rulings) until we are where we are today. There was one ruling in the Progressive Era that pushed the idea forward, and there have been others at various times too. The last big one was the 2010 Citizens United opinion. So there's a lot of precedent. The best way we could end this insanity is through a constitutional amendment. It's hard work but not impossible and that would settle the issue once and for all. One last detail about corporate personhood: it's pretty much a patchwork quilt of rights inasmuch as corporations can't marry or vote and or invoke the 5th Amendment against self-incrimination. But they have 4th Amendment rights. They do not have blanket personhood.
America has a long history of failing to act on fundamental issues (like slavery) until it's impossible to ignore the problem anymore and then we get busy and address it. I have hope that will happen with this problem. And I think we are entering a phase in our history where the matter of corporate personhood becomes more likely to become wiped off the books, either through a SCOTUS ruling or constitutional amendment.

I ended up with a Democrat identifying as a Republican for my congressman, thanks to huge funding from the GOP. There were 3-4 far more Republican candidates in the race, yet the GOP chose to support the candidate farthest to the left. It's despicable.
There’s always the option of a write-in. It’s not a wasted vote. It’s a statement that the available candidates are not acceptable and we’re not going to vote for them any more. Until we insist on that, we’ll get more of the same. The voters need to stop caving to the Big Money. Until we stop caving we can’t complain about the politicians who cave.
Well, in many cases a write-in risks loss to a worse candidate.
In the case noted above, there actually WERE several much better options. None were able to receive funding from the GOP for their campaigns. And in one instance, the preferred candidate's ads explicitly attacked a less RINO candidate who had served in another state office for many years.
My point is that the GOP is equally slimy. And that voters are often deprived of *meaningful, viable* candidates.
Voting for a write-in is an act of protest and I have done it. However, it often accomplishes little.
I agree with all that you say, but buying into the “we can’t have the worse candidate” perspective is exactly how the oligarchs keep us voting for their handpicked candidates, on both sides of the aisle.
They’re all voting for policies that harm us, so I believe we have to stop voting for the “better of two evils” if we want real change to happen.

Kennedy: The people who've given Sen. Warren one milllion dollars in campaign contributions created the product that created these things and probably every person on this committee doesn't care an iota about this scientific and medical truth. As secretary of Health and Human Services, you want me to just ignore this?
